General Legal Disclaimer

Nextgen Interarts Foundation ("NIF") is a nonprofit organization based in Massachusetts, dedicated to fostering creative, inclusive, and socially responsible programming through art, performance, and interdisciplinary community initiatives. This legal disclaimer is issued to clarify the Foundation’s limited liability and outline the responsibilities of all individuals engaging with our programs and spaces.
 

Scope of Applicability

This disclaimer applies to all individuals who interact with NIF in any capacity, including but not limited to:

  • Volunteers

  • Event participants and attendees

  • Workshop instructors and students

  • Artists and performers

  • Partner organizations and collaborators

  • Parents or guardians of minors involved in NIF programs
     

Participation and Risk Assumption

Participation in any NIF-sponsored activity—such as exhibitions, workshops, competitions, community projects, or outreach events—is entirely voluntary. By choosing to engage with NIF, you expressly acknowledge and accept the following:
 

  • You assume full responsibility for any physical, psychological, or emotional risks, injuries, losses, or damages that may occur during or as a result of participation, including risks related to crowd gatherings, material handling, environmental exposure, or interpersonal engagement.

  • NIF, its staff, directors, volunteers, affiliates, and venue partners are not liable for any direct or indirect injury, loss of property, illness, or damages, except where required by law due to gross negligence or willful misconduct.

  • You are solely responsible for maintaining your own health and personal insurance coverage.

  • Your participation does not constitute employment, nor does it entitle you to benefits, protections, or compensation typically afforded to employees.
     

Health and Safety Notice

While NIF prioritizes the safety and well-being of all participants, it cannot eliminate all potential hazards. NIF reserves the right to:

  • Modify or cancel programs for safety or logistical reasons without prior notice;

  • Enforce safety protocols including masking, distancing, or health screening in accordance with public guidelines;

  • Deny or revoke access to any individual who exhibits unsafe, disrespectful, or unlawful conduct.
     

Intellectual Property and Creative Content

All works presented, created, or shared within the context of NIF programs—including artworks, performances, designs, writing, media, or workshop materials—are protected by intellectual property laws.
 

Participants agree to:

  • Refrain from copying, recording, photographing, distributing, or reproducing any such content without prior written authorization from the Foundation or the content creator.

  • Recognize that all contributions made as part of a volunteer or collaborative role may be used by NIF for non-commercial, educational, or promotional purposes, with proper attribution where feasible.

NIF retains ownership or licensing rights over content created under its direction, unless explicitly waived in writing.
 

Media Release

NIF may document its programs through photography, video, and audio. These materials may be used in print or digital communications, social media, grant reporting, or archival purposes.

By entering an NIF-affiliated space or event, you consent to being photographed or recorded unless you notify us in advance via email or in writing. Reasonable accommodations will be made when possible.


Confidentiality and Behavioral Expectations

Participants agree not to disclose sensitive, personal, or internal information obtained through engagement with NIF. Any harassment, discrimination, intimidation, or misconduct—verbal, physical, or digital—will not be tolerated and may result in removal or legal action.
 

Minors and Guardianship

Parents or legal guardians must provide written consent for minors to participate in NIF programs. NIF does not assume legal responsibility for unaccompanied minors beyond reasonable supervision during designated activities.
 

Force Majeure and Program Changes

NIF shall not be held liable for failure to deliver services or programming due to events beyond its control, including but not limited to natural disasters, public health emergencies, strikes, or acts of government.

Acceptance of Terms

By participating in NIF events, programs, or services—or by entering a facility or venue under its control—you affirm that you have read, understood, and agreed to abide by this General Legal Disclaimer.
 

If you do not agree with these terms, you should refrain from participation or contact us with your concerns prior to engagement.
