Brand and Intellectual Property Legal Notice

The NextGen InterArts Foundation (“NIF”) is a U.S.-registered 501(c)(3) nonprofit organization incorporated under the laws of the Commonwealth of Massachusetts, committed to advancing interdisciplinary arts education and youth mental wellness.
 

To safeguard the identity, mission, and intellectual contributions of NIF, this Legal Notice outlines the copyright, trademark, and content protection policies that apply to all materials produced by, on behalf of, or in collaboration with the Foundation.
 

1. Protected Brand Assets

The following are the intellectual property of NIF and are protected under applicable U.S. and international copyright, trademark, and related laws:

  • The names “NextGen InterArts Foundation,” “NextGen InterArts,” and the abbreviation “NIF”

  • Official logos, wordmarks, visual identity elements, and color systems

  • Program and event names (e.g., XC Creative Art Contest, Sound Healing Series)

  • Curricular frameworks, program structures, lesson plans, activity guides, and handbooks

  • Website content, publications, marketing collateral, and digital communications

  • Original text, photography, video, design, and exhibition content created by or for NIF

  • Educational tools, assessments, evaluation criteria, and training modules


Trademark Protection Notice
The names “NextGen InterArts Foundation” and “XC Creative Art Contest,” along with associated logos and brand elements, are proprietary trademarks of NIF. Unauthorized use of these names or any similar identifiers is strictly prohibited and may constitute a violation of trademark law.
 

2. Prohibited Uses Without Permission

Unless prior written consent is expressly granted by NIF, no individual or entity may:

  • Use, replicate, or alter NIF’s name, logos, or program/event titles in any capacity

  • Reference NIF or its work in funding proposals, academic publications, or public platforms

  • Adapt, excerpt, or publish NIF content externally (print, digital, or social media)

  • Use NIF-developed materials for commercial instruction, consulting, or resale

  • Organize competitions or exhibitions replicating NIF’s brand, format, or evaluation model

  • Distribute, translate, or redesign internal documents, rubrics, or templates

  • Record or broadcast any NIF program or event without permission

Violation of these terms may result in civil or administrative legal action.
 

3. Ownership of Collaborative and Commissioned Works

All works produced under commission or formal partnership for NIF—including curricula, media, graphics, or documentation—are the property of NIF, unless a written agreement states otherwise.

  • Contributors may not redistribute or reuse these materials beyond the agreed scope without prior written approval from NIF.

Unless expressly agreed otherwise in a written contract, all intellectual property created under commission, partnership, or volunteer engagement with NIF—including educational content, media assets, visual materials, and supporting documentation—shall be the sole property of NIF.

Contributors are not permitted to publish, distribute, or repurpose such materials beyond the agreed project scope without prior written authorization from NIF.
 

4. Digital Content and Online Presentation

All content published on www.nextgeninterarts.org and affiliated digital channels—including website copy, layout, code, imagery, downloads, and visual branding—is legally protected.

Any unauthorized duplication, extraction, or redistribution (including screen capture and scraping) constitutes copyright infringement.

NIF utilizes monitoring tools and third-party IP protection services to enforce its rights online.
 

5. Legal Remedies and Enforcement

NIF reserves the right to initiate legal proceedings in response to:

  • Infringement of copyright, trademarks, or trade dress

  • Unauthorized commercial use of NIF intellectual property

  • False or misleading claims of affiliation with NIF

  • Derivative works or reproductions that imitate NIF programming or materials

Remedies may include:

  • Cease-and-desist notifications

  • DMCA takedown submissions

  • Claims for compensatory or statutory damages

  • Petitions for injunctive or equitable relief under U.S. and international law
     

Governing Law: All legal claims relating to this notice shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, and any disputes shall be exclusively adjudicated in the state or federal courts located in Suffolk County, MA, unless otherwise required by applicable law.
 

6. Requests for Use and Partnership

Parties seeking to use NIF content or branding, or proposing collaborative initiatives, must submit a written request to: info@nextgeninterarts.org
 

Requests will be reviewed based on relevance to NIF’s mission, alignment with public interest, and legal considerations. Approval is discretionary.
 

7. Disclaimer and Modifications

This Legal Notice is intended solely for informational purposes and does not constitute a waiver of any legal rights or protections held by NIF.

NIF reserves the right to modify this policy at any time. The version available on the Foundation’s website shall take precedence over all prior versions.

This notice does not limit NIF’s legal recourse under applicable state and federal laws, including but not limited to:

  • Massachusetts Uniform Trade Secrets Act

  • Massachusetts Consumer Protection Act (Chapter 93A)

  • U.S. Copyright Act and Lanham Act (Trademark Law)
     

8. International Use & Reporting Violations

This policy applies globally. Users outside the U.S. must comply with local laws while honoring NIF’s rights under U.S. and international intellectual property frameworks, including the Berne Convention and WIPO treaties.
